Welcome to Jacked Up Dirty Soda & Beverage Co. LLC, These Terms & Conditions govern your use of services, including purchases from our mobile beverage trailer, event bookings, and mobile or online ordering. By using our services, you agree to these Terms. 

 

1. Use of Services

 

• ​You agree to use our services for lawful purposes only.​

• We reserve the right to refuse services to anyone for unsafe, inappropriate, or unlawful behavior.

2. Products & Availability 

​

• All beverages are made fresh to order.

• Menu items, ingredients, and pricing may change without notice. 

• Availability may vary based on supply, events, or seasonal offerings. 

 

3. Payments & Refunds

 

• We accept approved forms of payment including cash and card. 

• All sales are final. Refunds or remakes may be issued at our discretion in case of an error on our part. 

 

4. Allergens & Health Disclaimer 

 

• Our beverages may contain or come into contact with common allergens, including dairy, nuts, fruit, and flavor additives.

• You are responsible for informing us of any allergies prior to ordering.

• By purchasing, you acknowledge and accept all risks related to consumption.  

• We are not liable for allergic reactions or health-related issues.

5. Mobile Operations

​

• As a mobile business, our hours and locations may vary.

• We may close, relocate, or adjust operations due to weather, private events, mechanical issues, or unforeseen circumstances. 

• Notice will be provided when reasonably possible.

6. Special Events & Private Bookings 

​

• A non-refundable deposit of 50% is required to secure event bookings. 

• Remaining balances are due 30 days prior to the event.

• Cancellations and refunds are subject to our Event Booking Policies.

• The client is responsible for providing adequate space, safe access, and any required permits or approvals. 

 

7. Promotions & Loyalty Programs

 

• Promotions, discounts, and loyalty Programs may change or end at any time without notice.

• Offers cannot be combined unless explicitly stated.

8. Intellectual Property

​

• All branding, logos, menu items, names, and content are the property of Jacked Up Dirty Soda & Beverage Co, LLC, and may not be used without written permission.

9. Limitation of Liability 

​

• To the fullest extent permitted by Tennessee state law, we are not liable for any indirect, incidental, or consequential damages arising from your use of our products or services. 

• All products are consumed at your own risk. 

 

10. Indemnification 

 

 You agree to indemnify, defend, and hold harmless Jacked Up Dirty Soda & Beverage Co. LLC, its owners, employees, and affiliates from   and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:​

• Your use of our services or products;

• Your violation of these Terms; or

• Your presence at or interaction with our business operations.

This includes, but not limited to, your presence at:

• Our regular service location;

• Any mobile or temporary location;

• Private events, public events, festivals, or pop-ups where we are operating. 

By interacting with our services, you acknowledge and accept the risks associated with a mobile food and beverage operation. ​

11. Mobile Ordering

Order Accuracy 

• You are responsible for ensuring your order details are correct before submitting.

Pickup Times

• Pickup times are estimates and may vary due to demand, weather, or operational delays. 

 

Cancellations & Refunds

• Orders cannot be canceled or modified once placed.

• Refunds are issued only at our discretion in the case of an error on our part. 

 

Pickup Responsibility 

• You are responsible for picking up your order at the selected location and time. 

 

Third-Party Platforms

• Orders placed through third-party Platforms may be subject to additional terms and fees. We are not responsible for third-party issues.

 

12. Missed Pickup/Abandoned Orders

• Orders not picked up within 60 minutes of the scheduled pickup time may be considered abandoned. 

• Due to the perishable nature of our products, we are not responsible for the quality of unclaimed orders. 

• No refunds, credits, or remakes will be issued for missed or abandoned orders.

• We reserve the right to discard or redistribute unclaimed orders at our discretion.

If something unexpected comes up, please reach out to us as soon as possible. We will always do our best to help when we can.

13. Governing Laws

​

• These Terms shall be governed by the laws of the state of Tennessee.

• Any disputes shall be resolved in the appropriate courts within Tennessee. 

 

14. Food Safety & Compliance 

 

• We operate in accordance with regulations from the Tennessee Department of Health and applicable local authorities.

• Customers agree to follow any posted safety guidelines while at our service locations. 

 

15. Changes to Terms

 

• We reserve the right to update these Terms at any time. 

• Changes will be posted with a new Effective Date. Continued use of our services constitutes acceptance of those changes.
